Who operates Splash and what these terms cover
“Splash”, “Splash Studio”, “we”, “us” and “our” refer to the operator of the Splash Discord application and its related website at splashstudio.net, account dashboard and associated services (together, the “Service”). Splash Studio is a service name, not a representation that a particular corporate form exists. For support or operator contact, email support@splashstudio.net.
These Terms govern your use of the Service as a server administrator, account holder or other user. The Privacy Policy describes personal-data handling; the Refund Policy describes subscription cancellation, refunds and withdrawal rights. Discord and other third-party services have separate terms. In the event of a conflict concerning a Paddle purchase, the applicable Paddle buyer terms govern that purchase.
Acceptance, eligibility and authority
By using Splash, signing in, authorizing it on a Discord server or purchasing related functionality, you agree to these Terms to the extent permitted by applicable law. If you do not agree, do not use the Service and remove its access from servers you control. These Terms do not replace any consent that must separately be collected by law.
You must satisfy Discord’s applicable minimum age and legal requirements. To buy paid plans, you must be legally able to enter the purchase contract or have any legally required authorization. If acting for a community, company or other organization, you confirm that you have the authority to install, configure and use Splash on its behalf. You are responsible for obtaining any additional consent or giving notices required for your server.
Discord platform and permissions
Splash is an independent third-party application and is not owned, endorsed or operated by Discord. Your use must comply with Discord’s Terms, applicable policies and permissions. Discord may alter or restrict APIs, bot permissions, account access, rate limits and integrations.
Installing Splash authorizes the specific functions and permissions presented by Discord. These can include reading relevant events, processing messages for enabled moderation features, managing roles/channels and taking moderation actions. The permissions you grant may affect how the bot operates. Review them before installation; you can remove the bot using Discord’s server controls. Splash never grants itself permissions beyond Discord’s authorization system.
Feature availability and changes
Splash offers combinations of server security, moderation, verification, dashboard controls and optional paid features. Features labelled preview, demo, planned, beta or unavailable are not live promises. A pricing plan or marketing demonstration does not mean every described feature is deployed or functional. Consult Features and Documentation for the current status and technical limits.
We may reasonably modify, improve, restrict or discontinue functionality for security, legal, technical or operational reasons. We will give appropriate notice of material adverse changes where reasonably possible or required. If a paid service materially fails to conform to a purchase or mandatory consumer guarantee, your statutory remedies are unaffected.
Administrator responsibility and automated actions
You configure Splash and remain responsible for server policy decisions, permission grants, moderation choices, appeal handling, retention decisions under your control and human oversight. Keep appropriate independent backups of critical server information. Review action thresholds and exception lists before enabling automated actions.
Automated detection is imperfect: a legitimate member can be flagged, an attack can escape detection, and Discord permissions, API availability, role hierarchy or external services can prevent or delay action. Moderation actions may be difficult or impossible to reverse. No bot can guarantee that a Discord server will not be raided, nuked, compromised or lose information. Do not treat Splash as a substitute for secure accounts, least-privilege roles, Discord-native controls or human administration.
Acceptable use
You must not use Splash to break the law, harass others, discriminate unlawfully, spam, scrape or misuse Discord data, circumvent Discord safeguards, test or attack systems without authorization, distribute malicious code or interfere with the Service. You must not attempt unauthorized access to other servers or accounts, abuse trials or payments, reverse engineer restricted service components except where law permits, or use the bot for undisclosed surveillance.
You are responsible for the content and configuration you submit and must have the rights and lawful basis to use them. We may investigate credible abuse reports and take proportionate measures, including disabling affected functions or access, where lawful and reasonably necessary.
Paid plans, Paddle and renewals
When subscriptions are offered, paid plans and optional add-ons are sold through Paddle acting as authorized reseller and Merchant of Record. Paddle handles the purchase transaction, applicable taxes, payment receipts, billing disputes and refunds subject to its Buyer Terms. Splash supplies the software/service and determines eligible functionality.
Displayed prices, currencies, billing periods, free trials and checkout totals are determined by the offer shown at the time of purchase. Monthly and annual subscriptions renew automatically unless cancelled. Any free trial converts to a paid subscription according to the checkout disclosure unless cancelled in time. Cancellation is available using your Paddle receipt’s management link or Paddle Buyer Support; see our Refund Policy. Cancellation normally prevents future renewal rather than refunding an already-started billing period, subject to mandatory law and Paddle’s policy.
Accounts, access and security
Discord sign-in is used to associate authorized website actions with a Discord account. You are responsible for safeguarding your Discord account, connected third-party account access and your devices. Inform us if you reasonably suspect unauthorized use involving Splash. We may suspend or limit affected sessions during a security event, when required by law or to prevent harm, and will act proportionately where feasible.
Removing Splash from a server, signing out or requesting account-data deletion is not necessarily the same as cancelling a separate paid subscription; use the Paddle cancellation process as well to stop future charges.
Privacy and third-party services
Our handling of account, server, moderation, security, verification and billing-related information is described in the Privacy Policy. Your server’s administrators may also have their own privacy responsibilities. Third-party services such as Discord, Cloudflare, Google and Paddle independently control portions of their services and their privacy practices. Some optional integrations require separate permission and can be disconnected where supported.
Our intellectual property and your content
Subject to these Terms, we grant you a limited, non-exclusive, revocable, non-transferable right to access and use the Service for its intended purposes while it remains available and you comply with the Terms. You do not acquire ownership of Splash’s software, branding, documentation or design. We retain our rights, and third-party owners retain theirs.
You retain rights to material you lawfully provide. You grant us only the limited rights necessary to process that material to operate the functions you request, protect the Service and satisfy lawful obligations. This is not a grant to sell Discord user data, train models on private messages or market to members using Discord API data.
Service provided as available
To the fullest extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis without any promise of uninterrupted operation, perfect detection, perfect accuracy or protection against every threat. We do not warrant that content, files or server configurations are recoverable after an incident, or that the Service will work with every Discord or third-party change.
These statements do not exclude remedies for lack of conformity, statutory guarantees, gross negligence, wilful misconduct, personal injury or other rights that cannot legally be waived. We will not use this section to disclaim an explicit paid commitment or any mandatory consumer protection.
Allocation and limits of liability
To the maximum extent allowed by the law governing a claim, we are not liable for indirect or consequential losses, lost profits, lost opportunities or losses resulting from independent decisions or failures of Discord or other third parties where those losses were not reasonably foreseeable. Your own server-configuration decisions and failures to maintain separate safeguards may also be relevant to causation.
Where an enforceable contractual liability cap is permitted, our aggregate liability for claims concerning the Service is limited to the amount you paid for the affected Splash product during the 12 months preceding the event giving rise to the claim; for a free Service the cap is €50. This cap does not apply to losses or liabilities that cannot be limited by law, and does not reduce rights to statutory refunds, mandatory remedies, liability for intent or gross negligence, personal injury, or other non-excludable rights. This clause is not intended to deprive consumers of an effective remedy.
Claims caused by misuse
Where legally permitted and proportionate, business users agree to compensate us for third-party claims and reasonable direct costs arising from their unlawful use of Splash, violation of others’ rights or unauthorized actions, but not to the extent caused by our own wrongful acts. This business-user provision is not an automatic indemnity against consumers and does not override mandatory consumer law.
Suspension and termination
You can stop using the free Service and remove its Discord permissions at any time. We may suspend access when reasonably necessary to respond to fraud, non-payment, abuse, compromised credentials, serious terms violations or platform/legal requirements. Where safe and required, we will provide notice and an opportunity to resolve the issue. Subscription cancellation and refunds remain governed by the purchase terms and applicable law.
Provisions that reasonably need to survive termination, including accrued payment duties, lawful record retention, intellectual property and permitted liability limits, will continue to apply.
Governing law and disputes
These Terms are governed by the laws of Slovakia, excluding choice-of-law rules, unless mandatory law applicable to your residence provides otherwise. Consumers retain mandatory protections and access to courts or dispute-resolution procedures available under their applicable law. Nothing here requires a consumer to litigate exclusively in Slovakia when applicable law grants another forum. Before formal proceedings, you may contact support@splashstudio.net so that we can attempt to resolve the issue.
Changes to these Terms
We may revise these Terms to reflect operational, legal or technical changes. The last-updated date shows the published version. For significant changes affecting ongoing paid services, we will provide legally required advance notice or consent and applicable cancellation rights. Updates do not retroactively remove accrued statutory rights.
